Are you renewing your permit to legally work in the United States? Here’s what’s changing in 2025.
The Department of Homeland Security (DHS) announced a key measure on Tuesday that will benefit both non-citizen workers and American employers.
Beginning Jan. 13, 2025, a new rule will permanently go into effect that increases the automatic extension period for Employment Authorization Documents (EADs) from 180 days to 540 days for certain applicants who file their renewal on time.
The change responds to the needs of employers and workers to reduce interruptions in employment authorization while the U.S. Citizenship and Immigration Services (USCIS) processes renewal applications, federal authorities said in a press release.

What does this extension mean for immigrants?
▪ More time to work without interruptions
If you apply for your work permit renewal on time, you will have up to 540 days of automatic authorization while your application is being processed. Previously workers only had 180 days of automatic authorization.
▪ Impact on employers
This measure provides continuity to employers, allowing them to retain their workers will their work permit extensions are being processed and reduce bureaucracy that could affect their operations.
▪ Strengthening the local economy
More than 16 million jobs have been created in the U.S. since 2021, according to DHS. This rule helps keep authorized workers in the workforce, boosting local and national economies, officials said.

Who qualifies for automatic extension of employment authorization?
The rule applies to applicants who:
▪ Have submitted their EAD renewal application on time and it is pending.
▪ Eligible applicants who have submitted their EAD application on or after May 4, 2022.
If you fall into these groups, be sure to follow USCIS’s instructions to ensure your continued employment authorization.
Other recent changes to work permits
USCIS noted that it has also implemented measures to streamline the EAD processing process, including:
▪ Reducing processing times for adjustment of status applicants by half.
▪ Extend the validity of EADs from two to five years in certain categories.
▪ Expanding the possibility of submitting immigration forms online.

USCIS has indicated that if your work permit is about to expire, do not wait until the last minute.
