Owner of six Florida Subway locations shorted workers $14,800 in pay, feds say

The owners of six Jacksonville Subway franchise locations made employees work off the clock and didn’t pay overtime when they should have, according to a U.S. Department of Labor investigation.

Labor announced that Subway Management Group of Jacksonville paid $14,813 in earned back pay and $14,813 in liquidated damages. That $29,626 went to seven workers, an average of $4,232 per employee.

Phone messages from the Miami Herald seeking comment from Subway Management Group of Jacksonville’s owners and officers — president Matthew Carter, wife Penny Carter, Bradenton-based secretary/treasurer Fred Franco and vice president Walter Adams — have not been returned.

Wage and Hour Division investigators said they found that the Carters “required managers to make bank deposits and conduct store-to-store runs between the greater Jacksonville area locations. At one of their locations, investigators determined, the restaurants’ operators shaved hours worked from employees’ time cards.”

These are violations of the Fair Labor Standards Act (FLSA).

The locations involved were 6132-4 Merrill Rd.; 6765 Dunn Ave.; 1030 N. University Blvd.; 1580 Branan Field Rd.; 2710 Blanding Blvd.; and Subway Mayport Naval Station, 3604 Mayport Rd.

No matter the immigration or citizenship status of workers, they can speak with the department, which says it can handle calls in more than 200 languages.
