A man who was shot by a Miami police officer after an argument at a downtown hotel is in stable condition and being accused of several crimes including aggravated battery on an officer.

Around 7:30 a.m. Saturday, a person at the YVE Hotel on Northeast Second Street at Biscayne Boulevard flagged down an officer to report an “unruly, shirtless man in his 20s who was causing a disturbance,” the Miami Police Department said Monday.

Officers found the man, who escalated a verbal argument into a physical fight and turned his aggression toward officers, the department said. Officers tased and pepper-sprayed the man, but they said it had little to no effect on him.

An officer ended up firing her gun, striking the man. The shooting occured while thousands of people filled downtown Miami for the Ultra Music Festival at nearby Bayfront Park.

The man was identified as Phillip Richard Carson, 28, of Delray Beach, according to an arrest affidavit, which was mostly redacted. The department didn’t identify the officer who fired her gun.

Miami paframedics took Carson to Jackson Memorial Hospital’s Ryder Trauma Center. He underwent surgery and was in stable condition as of Monday. One officer who suffered minor injuries during the encounter was also taken to the hospital.

Carson is also facing charges of aggravated battery on a police officer involving a deadly weapon or causing great bodily harm, resisting an officer with violence and disorderly conduct, the affidavit said.

His case and his attorney were not listed yet in Miami-Dade court records. He was also not listed in jail records.

The Florida Department of Law Enforcement is investigating the shooting. The Miami Police Department is asking witnesses or those with information to contact FDLE or Crime Stoppers Miami at 305-471-TIPS.
