Man sexually assaulted 11-year-old girl in Dolphin Mall’s family restroom, police say

A man was arrested after an 11-year-old girl told her mother that he gave her a “marijuana gummy” before raping her inside a family restroom at the Dolphin Mall earlier this month, Miami-Dade police said.
David Rivero, 33, is charged with sexual battery of a minor by an adult. He remained behind bars Wednesday at Miami-Dade County’s Turner Guilford Knight Correctional Center after a judge denied him bail, records show. He was also ordered to stay away from the girl and the mall.
“The victim disclosed to her mother that the defendant gave her a marijuana gummy, took her into a family bathroom, pulled her pants down and took her virginity,” police said in his arrest report.
The incident happened around 6:30 p.m. Dec. 10.
After the girl told her mother what happened at the mall, 11401 NW 12th St., in Sweetwater, she took her daughter to Nicklaus Children’s Hospital for a medical examination, police said. There, the girl also told the doctor what happened.
Rivero was arrested Monday afternoon. During an interview with detectives, he confessed to sexually assaulting the girl, police said Wednesday in a news release.
According to the arrest report, the mall’s video surveillance spotted him entering and exiting the family restroom.
Rivero, who has pleaded not guilty, was booked into jail early Tuesday morning, records show.
