Police: Homeless man rapes mentally ill woman in Miami Beach alley

Two homeless men were arrested this week after one of them allegedly raped a mentally ill woman in a Miami Beach alley while the other was trying to distract passersby, police said.

Derrick Barnes, 52, was charged with sexual battery of a mentally defective person over 12 years old, battery, indecent exposure, and kidnapping. Bobby Lee Bryant, 54, was charged with accessory after the fact and kidnapping.

Miami Beach police were called to the corner of Espanola Way and Collins Court at 5:22 p.m. Monday in “reference to a possible sexual battery in progress,” according to the arrest affidavit.

Once officers arrived, witnesses directed them to the west corner of Collins Court where they found the victim walking naked toward Collins Avenue after Barnes had “dismounted” her, according to the police report.

Barnes “quickly sat up against the wall attempting to pull his pants up,” police said.

As the officer approached him, Barnes stood up with his pants and underwear down around his knees, according to the affidavit, with a used condom on the cardboard boxes next to him.

Witnesses told police that they had seen the victim lying on the north side of the street on Espanola Way when Barnes and Bryant passed her.

When the two men noticed that the woman was passed out on the sidewalk, they picked her up and dragged her about 93 feet across the street, placed her on cardboard boxes on the floor and started to take her clothes off, according to witnesses.

Once her clothes were off, Barnes “pulled his pants and underwear down and raped her, police said.

While Barnes was “penetrating the victim,” Bryant was standing at the corner “with his arms out in an attempt to block the sexual act happening behind him,” according to the affidavit.

Witnesses told police they heard Bryant telling passersby to “pay no mind” to what was taking place.

When officers interviewed the victim, they realized that she might suffer from a mental illness.

“When asked how old she was, she answered by stating ‘I’m 12 years old,’ ” according to the police report.

She could not tell them her name, date of birth or where she currently was.

She was taken to a rape treatment center.

Barnes and Bryant were booked into Turner Guilford Knight Correctional Center in West Miami-Dade, where they remain on no bond.
