Charges dropped against New York man accused on sexual assault in Miami Beach
A New York man who was arrested in Miami Beach earlier this year after a woman accused him of sexual assault is no longer facing charges.
Emmanuel Toussaint, 35, was taken into custody at the Mondrian Hotel, 1100 West Ave., on March 12 where police responded to a report of sexual assault.
Per investigators, the victim told detectives that she met several men at Mr. Jones nightclub but could not recall much of what happened afterwards. What she did remember, according to police, was waking up to non-consensual sex with a man that she did not know.
Around 4:30 a.m., police say surveillance footage showed the victim arriving at Toussaint’s hotel room with he and another man. The other man left the room 20 minutes later, briefly returned, then walked back out.
Shortly thereafter, the victim was seen running frantically from the hotel room, according to police.
Toussaint then exited the room, too, but was detained by hotel security until police arrived. He was interviewed at Miami Beach Police Department headquarters, but his statements were redacted from the arrest affidavit.
He was charged with sexual battery on a physically helpless victim and gang sexual battery with no serious injury and was booked into the Turner Guilford Knight Correctional Center.
However, on June 27, prosecutors dropped the charges against Toussaint and formally closed the case.
