He had sex with a 15-year-old, police said. Her pregnancy led to his arrest

Monroe County Sheriff's Office

A Big Pine Key man was arrested after police said he had sex with a 15-year-old girl in his trailer.

The girl became pregnant and that set off an investigation by the Monroe County Sheriff’s Office.

The girl told deputies that she was a willing participant and was not forced to have sex with Juan Miguel Matias Andres, who was arrested Dec. 20.

But Matias, 28, who is listed as a landscaper, cannot legally have sex with a girl that age.

He was arrested on a charge of sexual assault by someone 18 or older when the victim is under age 18 and at least 12.

Matias on Monday remained at the Stock Island Detention Center on $30,000 bond with a court hearing set for Jan. 3.

The girl’s pregnancy was discovered by police after she went to Fishermen’s Community Hospital alone on Nov. 8 to try to learn the age of her fetus, according to the arrest report.

A hospital caseworker called the sheriff’s office.

The girl is originally from Guatemala and entered the U.S. in Texas eight months ago. with her uncle and father — but they were deported due to DUI arrests after two months in the country, police said.

“Matias was the only male she has slept with ever,” wrote Detective Joshua Brady in the report.

She told police she is 24 to 26 weeks pregnant.

Her mother knows she is pregnant and lives in Guatemala. She said she met Matias through her uncle and was told he would take care of her, Brady wrote.

Matias initially said he had sex with the girl after she was pregnant, authorities said. But police said when they told him that when the child was born they would be able to learn who the father is, he said he might be the father.
