Florida roofer violated federal pay laws in shorting workers $46,302, Labor announces

A Gainesville roofer paid $46,302 in back pay after a U.S. Department of Labor investigation found the company violated the Fair Labor Standards Act in several ways, the agency announced.

That money went to 29 employees of Crosier & Son Roofing, an average of $1,596.62 per worker. Crosier declined to comment Monday when reached by the Miami Herald.

According to Labor, Wage and Hour Division investigators learned Crosier, in business for more than two decades:

Made workers show up at 6:45 a.m. to get trucks and equipment ready to head for the job sites, but didn’t consider them on the clock until they got to the job sites.

Considered them off the clock when they left the job sites, though workers still had to return trucks and equipment

Didn’t record overtime hours in their payroll and paid overtime in cash.

“Workers deserve to be paid all the wages earned for all the hours they work,” Wage and Hour Division District Director Wildalí De Jesús said. “When workers are required to complete any tasks before their shift begins, the workday begins at the start of those tasks and it continues through the completion of the last post-shift activity.”

The Wage and Hour complaint section of Labor’s website contains information on how to file a complaint. Miami’s Wage and Hour Division office can be reached at 305-598-6607. The national helpline is 866-4US-WAGE (487-9243). No matter a worker’s immigration or citizenship status, he or she can speak with the department, which says it can handle calls in more than 200 languages.
