Second fondling suit filed against Palm Springs Hospital in Hialeah

A second lawsuit has been filed against Hialeah’s Palm Springs General Hospital for the conduct of a male nursing assistant who allegedly fondled two patients.

The second lawsuit alleges that Rene Martinez repeatedly fondled a man identified only as John Doe after “gazing” at his genitals in a “lustful manner” in February 2011. The patient, who had been admitted to the emergency room for a hernia, was laying on a bed in his hospital gown.

“This sexual contact was unwelcome and offensive,” according to a lawsuit filed Monday by lawyer Jeff Herman.

Martinez, 52, is still facing a lawsuit filed in November by another man who secretly video-recorded a similar incident on his cellphone at the hospital at 1475 West 49th Pl. The hospital did not respond to phone calls.

The nursing assistant was arrested for the incident. He is still awaiting trial for two counts each of misdemeanor battery and committing a lewd and lascivious act.
