Cypress Bay High restroom photog may be charged
A charge of misdemeanor video voyeurism is possible against a male high school student who took pictures of girls in a girls' restroom.

The male student who snapped photos of females in a restroom at Cypress Bay High School in Weston could be charged with misdemeanor video voyeurism, officials said Tuesday.
They identified the student, a senior, as the stepson of a Broward Sheriff's Office detention deputy.
Charges will be presented to the Broward State Attorney's Office on Wednesday, and prosecutors will decide whether the teenager should be arrested and charged, said BSO spokesman Jim Leljedal.
Leljedal said there was ``no indication'' that the teen received special treatment because of his stepfather, who works at the Pompano Beach Jail.
The 17-year-old, whose name was not released because of his age, returned to school Tuesday after a 10-day suspension, Cypress Bay officials said.
The student is forbidden from bringing a cellphone or other electronic device to campus, and must receive counseling, said Broward school district spokeswoman Marsy Smith. She said the school district was also considering expelling him.
Although a criminal charge is being recommended, BSO said Tuesday that the continuing investigation revealed that none of the photographs showed females actually using the facilities.
The teen deleted the pictures under the direction of a deputy who had determined they did not contain any nudity, according to a previous report.
However, that deputy, after viewing the cellphone pictures, wrote in his initial report that ``the photos were taken from a distance showing the female occupants sitting, squatting and standing on a toilet with no visible sightings of female nude private parts.''
Leljedal said Tuesday that BSO policy on erasing potential evidence makes the decision ``a judgment call'' on the part of the deputy at the scene.
``It was a fairly unique situation,'' Leljedal said. ``The deputy looked at the photos and felt he could resolve the situation on his own.''
The student was caught Aug. 27 after he entered the girls' upstairs restroom during a lunch period, went into a center stall and took photos of three females with his camera phone, the report stated.
The report did not say whether all three were students or if any of them were teachers.
BSO was called to the school the next day, after a female student complained about ``seeing someone taking photos from an adjacent bathroom stall.''
The girl's father told The Sun Sentinel that his daughter was ``petrified'' after she saw someone stick a hand, which was wrapped in a shirt, under the stall partition.
She reported the incident to administrators, who reviewed a video recording of activities in the hallway and caught the teen walking out of the restroom. The student victim also identified him based on his clothing.
``His reasoning for using these particular restrooms was because classes in the building are usually at lunch and they were very quiet and clean,'' the report said.
``Shortly after entering, he thought about looking under the stalls as females entered to use the restrooms but feared getting caught so he decided to take pictures with his camera phone instead.''
