First, the tenant told police, he found most of his belongings on the sidewalk outside of this Little Haiti apartment. So he went downstairs to the parking lot, where the landlord shot him in the leg.
“The witness stated that the victim was not arguing or yelling at the defendant and that the defendant shot him in the right leg for no reason,” the responding Miami police officer wrote in a police report.
Police found Gerard Rivera-Domenech, the shooting suspect and the landlord of the building at 7825 NW Fifth Ct., walking away from the scene. When he was confronted, he told police he got rid of the gun.
Police have not found the weapon.
On Tuesday afternoon, Rivera-Domenech, 40, was arrested and charged with aggravated battery and using a firearm while committing a felony. He was booked into the Turner Guilford Knight correctional facility.
The victim, who has not been identified, was taken to North Shore Hospital and is recovering.
