Miami police do not believe NFL star Colin Kaepernick was present when they responded to a pair of 911 calls about an upset naked woman refusing to leave a downtown Miami hotel room.
But they are waiting for the Viceroy Hotel to turn over additional surveillance tape so they can try to see whether the quarterback for the San Francisco 49ers had been in the suite earlier with two other players and, if so, when he left.
Miami Police Chief Manuel Orosa said that, so far, police have not confirmed the woman’s report that Kaepernick had been among a trio of men in the hotel room on the night of April 1. She named him in a report she filed with police two days after the incident.
Police already have one surveillance tape from the Brickell-area hotel that only shows Miami Fire-Rescue transporting the woman from the room just after midnight, a source familiar with the investigation said this week. The Sacramento Bee has reported that the suite was Kaepernick’s.
Last week, police confirmed that Kaepernick, 49ers wideout Quinton Patton and Seattle Seahawks receiver Ricardo Lockette were under investigation in connection with the incident.
The woman reported that she had blacked out naked in the hotel room after a night of doing shots and bong hits in room 4710 in the posh Viceroy. She reported that she had mixed drinks for herself and the three men and that they coaxed her into smoking marijuana before she passed out.
Kaepernick lashed out at TMZ, the entertainment and gossip website, and other outlets on Twitter last week, saying he did nothing wrong. His agent Scott Smith declined to comment Friday.
No charges have been filed, but a police incident report taken when the woman went to police on April 3 shows the case is being investigated by the department’s Special Victims Unit, which looks into sex crimes.
The woman has undergone a rape test, police said. The results have not been made public. Police are also waiting for results of a toxicology report from the woman.
Orosa said all evidence, including surveillance tapes, will be turned over to the state attorney.
The woman, who is not named in the police report, said she has had a past sexual relationship with Kaepernick. She told police that before she passed out, she and Kaepernick were kissing in the bedroom.
After she got undressed, she told police, Kaepernick left the bedroom. She said they didn’t have sex.
The woman said that at some point, Lockette and Patton peeked into the room. She told police that she yelled at them to leave. The incident report said the woman had no recollection of anything else that happened that night until waking up in the hospital several hours later.
Miami Fire-Rescue Lt. Ignatius Carroll confirmed that paramedics visited the Viceroy at 12:32 a.m. on April 1 and transported a 25-year-old woman to Jackson Memorial Hospital.
Miami police also said they expect to discuss the incident with an attorney representing the three football players in the next few days.
Police are also expected to release a pair of 911 tapes on Monday. One tape, police say, is of a male voice asking for help to remove a woman from the hotel room who he claims refused to leave until “the player she came to see returns.”
The other 911 tape is from hotel security, police said.
Last week, the Sacramento Bee reported that Lockette called 911 twice on his cellphone the evening of the incident, telling police that a naked woman was on his friend’s bed and refused to leave.
CBSSports.com reported Friday that San Francisco has put a hold on extension talks with Kaepernick while Miami police continue to investigate.
