A probation-violation hearing for Robert Ray Huizenga was recessed after two hours Wednesday so the prosecutor could size up a defense witness.
The charge that brought the son of businessman H. Wayne Huizenga to court stemmed from his fourth arrest on DUI charges. Robert Huizenga, 47, has been jailed since his July 20 arrest for drunken boating after he tried to dock at the wrong house on a Fort Lauderdale canal.
The hearing, which will resume Dec. 10, began with Huizenga admitting he violated his probation by drinking alcohol the night of the incident. During the recess, the prosecutor will take a deposition from Huizenga's companion that night, Patrick Stewart, whom the defense has called as a witness.
Broward Circuit Judge Michele Towbin Singer now must rule on whether Huizenga also violated his probation by boating while under the influence.
Defense attorney David Bogenschutz contends that while police may have seen his client behind the wheel of the idling boat, they did not see him operating the vessel.
In a videotape, Huizenga told Broward Sheriff's DUI Task Force Deputy Robert J. Hager Jr. that he had not driven the boat for hours, then switched to say that it had been an hour. He first told the deputy he walked from Las Olas Boulevard, then said he rode his bicycle.
``Sir, why are you doing this to me?'' Huizenga repeatedly asked the deputy, referring to the ``big trouble'' he was going to be in.
Huizenga was on probation at the time for a 2003 drunken driving incident that left a 71-year-old pedestrian with a concussion, a gashed head and a broken elbow.
What triggered Huizenga's latest arrest was an 11:15 p.m. call to Fort Lauderdale police regarding a suspected burglary in the 300 block of Lido Drive, off Las Olas Boulevard.
The caller told police two men were trying to open the back door of her house. Huizenga's home is on the other side of the canal.
If Towbin Singer finds that Huizenga violated probation, he could face up to five years in prison.
