Josh Woodward was released from jail early Wednesday, but the L.A. DA still says there's not enough evidence to file charges against him.
``This is a very complicated case . . . that will require expert witnesses,'' said LAPD Deputy Chief Charlie Beck at a press conference. ``It is a case that will require extensive scientific analysis of substance.''
Investigators are working to gather more evidence against the 8 Oz Burger Bar co-owner who was arrested Sunday in the death of a 13-week-old fetus believed to be his.
Murder charges, however, will be tough to come by. ``Normally we're looking at the third trimester before a murder charge could really apply,'' ABC News legal analyst Dana Cole told KABC. ``If the fetus could not have survived, it will never be a murder case. It could be an assault case.''

Congrats are in order for real estate developer Don Peebles, who has landed on the cover of November's Black Enterprise Magazine, which calls him ``the master blacksmith of entreprenurialism.'' And to Michael Aller, a.k.a Mr. Miami Beach, for not only being the voice behind the world's only ``human'' tourism hotline -- Aller says every call is answered or returned -- but also for receiving the Nestor Torres Cultural Ambassador Award.
Lady Gaga fans, rejoice: the funky singer has added a second Miami date to her Monster Ball Tour, taking place two days after her New Year's Eve show at the James L. Knight Center; ticketmaster.com.
