DOT lawyer asks judge reconsider his ruling on citations

The Florida Department of Transportation has asked a judge who threw out an estimated 7,000 of traffic tickets to reconsider his ruling, saying it was too broad.

The department on Friday filed papers to ask Circuit Judge John Galluzzo for a rehearing in the case, which involved drivers with malfunctioning devices used to pay tolls. Galluzzo was wrong to issue such a sweeping order in the case, which asked him to rule only in the case of one driver, department attorney Gregory Costas said.

Galluzzo dismissed the tickets, which involved drivers in Seminole and Brevard counties, in April. He said citations could not be issued if drivers had automatic toll-paying devices and an active credit-card or prepaid account. Those drivers had committed no traffic infractions, he wrote.

The citations involved drivers who had E-Pass and SunPass toll systems.

Phone and e-mail messages left for Costas by The Associated Press on Saturday were not immediately returned.
