Miami Police finally catch up with suspect who shot another after confrontation

An angry homeowner approached Gilberto Rivera Martinez almost three months ago because he saw Martinez urinating in front of the man’s home.

So Martinez, 38, pulled out a gun and shot the homeowner, Jose Diaz Martinez, Miami police said. The two men are not related.

Jose Diaz Martinez — who lives in the 1800 block of Southwest Third Street — survived the shooting back in March.

On Wednesday, police found Gilberto Rivera Martinez at a home in the 3100 block of Northwest 26th Street and arrested him on a charge of attempted murder.

A friend of Jose Diaz Martinez was much luckier that March day. He told police the two men actually confronted Gilberto Rivera Martinez.

After his friend was shot, the man said, the shooter turned the gun on him.

He said, “You, too,” a Miami officer noted in the arrest affidavit.

But the gun didn’t fire, it only clicked, and the shooter ran off.
