Lawyers for Fontainebleau owner Jeffrey Soffer have filed a motion to dismiss a wrongful death case against him. Daria Pastouhkova Gogoleva, the woman who filed the lawsuit against Soffer and others involving a 2012 helicopter accident, is not the widow of the man who died in the accident and therefore the case should be dismissed, according to court papers filed Thursday in Miami-Dade Circuit Court.
The plaintiff, Gogoleva, alleged Soffer was behind the chopper’s controls during the accident in the Bahamas on Thanksgiving Day that killed her husband, Lance Valdez, having taken over mid-flight from the professional pilot, David Pearce. But because she is not the widow of Valdez, she does not have standing to bring a wrongful death cause of action in her individual capacity, the papers said.
On Dec. 11, 2012, Gogoleva filed an affidavit stating she had "indicated incorrectly, among other information that I was the spouse" of Lance Valdez on an official certificate of death, the court filing said, in seeking the dismissal.
