In a civilized society, the health and safety of the people trump an individual’s right to expose others to urination and defecation. The city of Miami’s Pottinger lawsuit concerns health issues that go hand in hand with our other freedoms. No one has the right to endanger the rest of us with the risk of spreading disease.
Pottinger has been rendered moot because Miami has built homeless shelters to eliminate the necessity of living in squalor on the streets.
Fortunately, they now have a choice and an opportunity to receive food, a place to sleep and a place to relieve themselves. Miami has fulfilled its part of the Pottinger agreement. Now, it is up to a U.S. district judge to modify the agreement to require the homeless to accept the public’s welfare offerings or to move on.
