Dump truck driver who hit Miami man will not be charged

The truck driver who ran over a man Saturday morning turned himself in to police hours later and will not face criminal charges, according to Miami police.

The driver, whose name police will release on Monday, never knew that he hit Wilfredo Santana, 54, at the gas station on 2810 NW 12th Ave.

“There was no criminal intent on the part of the driver,” said Miami police spokesman Rene Pimentel. “Based on the position the driver was in, there was no way of him knowing there was anything there, let alone a body.”

The driver, who surrendered at police headquarters, will also not face any charges because surveillance video showed Santana was in harm’s way.

“The guy was lying on the roadway to an entrance ramp,” Pimentel said.

Santana was known to hang out around the gas station, having been arrested more than a dozen times for disorderly conduct and public drunkenness, according to Pimentel.

Santana was pronounced dead on the scene.
