A federal judge hearing arguments Tuesday in a lawsuit filed by the city of Dania Beach regarding a new runway being built at Fort Lauderdale-Hollywood International Airport will likely issue a ruling by Friday.
Dania Beach filed the lawsuit after the Federal Aviation Administration in May refused to fund parts of a deal the city had struck with Broward County, which included a cash payout for 857 homeowners who live closest to the new runway in exchange for not taking legal action.
During Tuesday’s hearing before U.S. District Judge James Cohn, Dania Beach argued that the Army Corps of Engineers failed to examine vital information regarding the effects the new runway would have on public health, including data on the link between high noise levels and cardiovascular disease, hypertension and cognitive development in children, before it issued a permit for construction to take place at the airport, according to Neal McAliley, the city’s airport attorney.
The corps argued it was not its responsibility to do so, he said.
Cohn hopes to have his decision completed by Friday afternoon, McAliley said.
In the meantime, construction for the new runway at the airport is ongoing.
